The controversy surrounding the meaning of homosexuality is often based on two very different ways of understanding the phenomenon: essentialism, which insists on the innate nature of homosexuality, and constructivism, which maintains that homosexuality is a constructed identity. In this article, the author outlines the features of this double discourse on homosexuality, specifically in the context of the legal debates over the recognition of the rights of homosexuals, before drawing his own conclusions. Although the author acknowledges that essentialist arguments have served the cause of homosexual rights activists in Canada, he emphasizes that essentialism neglects the consequences of being labelled homosexual. The constructivist view is of great significance because law creates identifies, norms, and power.
